TERMS OF USE
CENTURY 21 EDGE
These Terms of Use ("Terms") are a legally binding agreement between you and Sunseria Real Estate Group, LLC, doing business as CENTURY 21 Edge ("CENTURY 21 Edge," "we," "us," or "our"). These Terms govern your access to and use of Century21Edge.com and any other website, subdomain, landing page, agent website, form, account, application, communication channel, or digital service that links to these Terms, including services powered by edgeONE (collectively, the "Services").
By accessing or using the Services, creating an account, submitting information, or clicking to accept these Terms, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, submit a request for brokerage services, or consent to marketing communications. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.
2. About CENTURY 21 Edge
Sunseria Real Estate Group, LLC d/b/a CENTURY 21 Edge is a licensed real estate brokerage. CENTURY 21 Edge supports Equal Housing Opportunity and provides real estate services without unlawful discrimination. The CENTURY 21 name and related marks are used under license. Each CENTURY 21 office is independently owned and operated.
Individual sales associates and broker associates affiliated with CENTURY 21 Edge may be independent contractors. References to an "agent" on the Services may refer to a licensed sales associate, broker associate, or broker, as applicable.
3. No Brokerage or Agency Relationship Created by Website Use
Using the Services, creating an account, saving a property, requesting information, contacting an affiliated real estate professional, or requesting a showing does not by itself create a brokerage, agency, fiduciary, representation, or customer relationship. Any brokerage relationship will be established and governed by applicable law and separate disclosures or written agreements. You should not assume that information submitted through the Services is confidential until the nature of the relationship and any applicable confidentiality obligations are confirmed.
4. Real Estate Information and IDX Data
Property listings and related information may be supplied by multiple listing services, listing brokers, public records, property-data providers, owners, builders, developers, and other third parties. Required MLS and IDX notices, attribution, copyright statements, update timestamps, and use restrictions displayed on the Services are incorporated into these Terms.
Listing information is provided for consumers' personal, noncommercial use and may not be used for any purpose other than identifying prospective properties in which a consumer may have a good-faith interest. You may not scrape, harvest, reproduce, republish, redistribute, resell, reverse engineer, create a consumer may have a good-faith interest. You may not scrape, harvest, reproduce, republish, redistribute, resell, reverse engineer, create a competing database from, or commercially exploit listing or property information except with express written authorization and all required MLS and rights-holder approvals.
Property information may be incomplete, delayed, inaccurate, or changed or withdrawn without notice. Availability, status, price, incentives, square footage, acreage, measurements, room dimensions, features, taxes, assessments, zoning, land use, permits, schools, boundaries, flood information, insurance, HOA or condominium information, rental restrictions, and other facts must be independently verified. Photographs may be digitally enhanced, virtually staged, or depict conditions that have changed.
5. No Professional Advice or Guarantee
Content on the Services is provided for general informational purposes. It is not legal, tax, accounting, financial, investment, mortgage, appraisal, inspection, engineering, environmental, insurance, title, survey, or other professional advice. Consult an appropriately licensed or qualified professional before making a decision. We do not guarantee that a property, transaction, service provider, financing option, or result will meet your needs.
6. Fair Housing and Consumer Choice
You may not use the Services to discriminate, express an unlawful preference or limitation, steer, harass, threaten, or deny housing-related opportunities based on a legally protected characteristic. Neighborhood, school, demographic, crime, lifestyle, or similar third-party information is not a recommendation about where any person should live. Consumers should evaluate communities using objective criteria that matter to them and verify information with authoritative sources.
7. Accounts and Security
Provide accurate, current, and complete information and update it when necessary.
Maintain the confidentiality of your credentials and do not permit unauthorized use.
Notify us promptly if you suspect unauthorized access or account misuse.
Do not create an account using false information, impersonate another person, or use another person's contact information without authority.
We may suspend, restrict, or terminate an account or access to the Services if we reasonably believe there is fraud, abuse, a security risk, a violation of these Terms, or a legal or operational reason to do so.
8. Acceptable Use
You may not:
Use the Services for an unlawful, fraudulent, discriminatory, deceptive, harassing, or harmful purpose.
Interfere with or disrupt the Services, bypass security or access controls, introduce malware, probe vulnerabilities, or overload infrastructure.
Use bots, spiders, crawlers, scrapers, data-mining tools, automated queries, browser automation, or similar means to access or extract information without written authorization.
Copy, modify, frame, mirror, sell, license, distribute, or create derivative works from the Services or content except as expressly permitted.
Remove attribution, copyright, trademark, MLS, IDX, or other proprietary notices.
Use contact information from the Services for unsolicited marketing, spam, harassment, or unlawful telephone, text, or email solicitation.
Upload or transmit content that infringes intellectual property, privacy, publicity, contractual, or other rights.
Misrepresent your identity, affiliation, authority, or intent.
9. Intellectual Property
The Services, their design, software, text, graphics, logos, videos, photographs, compilations, and other content are owned by or licensed to CENTURY 21 Edge, its franchisor, MLSs, listing brokers, vendors, or other rights holders and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Services for your personal, lawful, noncommercial use.
No right, title, or interest is transferred to you. Any use of the CENTURY 21 Edge, CENTURY 21, edgeONE, or other names, logos, marks, or trade dress requires prior written authorization from the applicable owner.
10. User Submissions
If the Services allow you to submit a review, comment, photograph, document, feedback, or other material ("User Content"), you retain any ownership rights you have. You grant us a worldwide, nonexclusive, royalty-free, sublicensable license to host, store, reproduce, format, display, transmit, and use User Content as reasonably necessary to operate, improve, promote, and protect the Services and respond to your request. You represent that you have the rights necessary to submit the User Content and that it does not violate law or another person's rights.
We may remove or restrict User Content at our discretion, but we are not obligated to monitor all submissions. We maintain a DMCA process described in our DMCA Notice.
11. Automated Valuations, Market Estimates, and Calculators
Any automated valuation, estimated value, equity estimate, rent estimate, market range, affordability calculation, mortgage calculation, payment estimate, or similar output is an estimate based on available data and assumptions. It is not an appraisal, broker price opinion, comparative market analysis, credit decision, loan approval, rate lock, offer to lend, or guarantee of market value or proceeds. Actual value, financing, payments, taxes, insurance, association charges, closing costs, and other amounts may differ materially. A property-specific evaluation by qualified professionals is required.
12. Artificial Intelligence and Automated Features
The Services may use artificial intelligence or automated tools for search, chat, content, translation, recommendation, summarization, routing, or administrative support. AI output may be incomplete, inaccurate, biased, outdated, or unsuitable for your circumstances. It is not a substitute for an affiliated real estate professional or another qualified professional. Verify material information independently and do not submit Social Security numbers, bank credentials, wire instructions, medical information, or other highly sensitive information to an AI or chat feature.
13. Communications and Electronic Records
You consent to receive documents, disclosures, notices, and records electronically when you transact with us electronically. You may need a current browser, internet access, and a device capable of displaying and retaining electronic records. A separate transaction or electronic-signature platform may provide additional disclosures and consent terms.
When you submit an inquiry or provide contact information, you authorize us and the affiliated real estate professional assigned to your inquiry to respond using the contact methods you provide. Marketing communications will be sent only as permitted by law and any consent you provide.
14. SMS and Telephone Terms
This section applies when you provide a telephone number, check a consent box, enroll in alerts, request communications, or otherwise agree to receive calls or text messages.
Program and sender. Messages may be sent by or on behalf of Sunseria Real Estate Group, LLC d/b/a CENTURY 21 Edge and an affiliated real estate professional responding to your request.
Message types. Messages may include property alerts, saved-search updates, showing and appointment information, inquiry responses, service and account notices, customer-care messages, and, when separately authorized, marketing or promotional messages.
Technology. Where permitted and authorized, calls or messages may use an automatic telephone dialing system, prerecorded or artificial voice, or other automated technology.
Consent is optional. Consent to marketing calls or text messages is not a condition of purchasing property, entering into a brokerage relationship, or receiving brokerage services.
Frequency and charges. Message frequency varies. Message and data rates may apply according to your carrier plan.
Opt-out. Reply STOP to a text message to opt out. You may also communicate a revocation request through another reasonable method recognized by applicable law. After an opt-out, you may receive a confirmation message. A request may apply more broadly where required by law.
Help. Reply HELP for help or contact 321-351-2121.
Carrier and delivery. Mobile carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may be affected by carrier, network, device, or service conditions.
Number reassignment. You represent that you are the subscriber or customary user of the number provided. Notify us or opt out before transferring or discontinuing the number.
No emergency use. The SMS program is not an emergency service and should not be used for urgent safety, law-enforcement, medical, or wire-fraud communications.
Privacy. Information collected through calls and messages is handled under our Privacy Policy.
To stop marketing email, use the unsubscribe link in the message. Opting out of marketing does not necessarily stop responses you request, account or security messages, transaction-related communications, or communications required by law.
15. Third-Party Services, Referrals, and Links
The Services may link to or integrate with independent lenders, title and settlement providers, insurance providers, inspectors, contractors, builders, developers, moving and utility providers, mapping services, social networks, and other third parties. A third party's services are governed by its own terms, licenses, privacy policy, and professional obligations.
A referral, link, directory listing, advertisement, or introduction does not guarantee or warrant a third party's licensing, pricing, availability, quality, suitability, or performance. You are free to shop for and select service providers. CENTURY 21 Edge or an affiliated person may receive advertising fees, referral compensation, or another benefit where permitted by law and disclosed as required. Any legally required affiliated business, settlement service, ownership, or compensation disclosure will be provided separately and is not replaced by these Terms.
16. Privacy and Cookie Choices
Our collection and use of personal information is described in the Privacy Policy. You may manage eligible cookies, targeted advertising, sale, or sharing choices through the 'Your Privacy Choices' link in the footer. The Services may not function properly if certain technologies are blocked.
17. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT, DATA, LISTINGS, TOOLS, AND FEATURES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' CENTURY 21 EDGE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND RESULTS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
18. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CENTURY 21 EDGE AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATED REAL ESTATE PROFESSIONALS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY; OR DAMAGES ARISING FROM RELIANCE ON LISTING DATA, THIRD-PARTY INFORMATION, AI OUTPUT, SERVICE PROVIDERS, OR UNAUTHORIZED ACCESS, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID DIRECTLY TO CENTURY 21 EDGE FOR THE SPECIFIC DIGITAL SERVICE GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME LIMITATIONS MAY NOT APPLY.
Nothing in these Terms limits liability that cannot legally be limited or affects rights you have under a separate written brokerage or transaction agreement.
19. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless CENTURY 21 Edge and its owners, officers, employees, affiliated real estate professionals, licensors, and service providers from claims, liabilities, damages, judgments, losses, and expenses, including reasonable attorneys' fees, arising from your unlawful use of the Services, your User Content, your violation of these Terms, or your violation of another person's rights. This obligation does not apply to the extent a claim results from a protected consumer right or conduct for which indemnity is prohibited by law.
20. Suspension and Termination
We may modify, suspend, discontinue, restrict, or terminate all or part of the Services or your access at any time for legal, security, operational, business, or policy reasons. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations, indemnification, and dispute provisions.
21. Changes to the Services or Terms
We may update the Services and these Terms. The revised Terms will be posted with a new Effective Date. Where required, we will provide additional notice or obtain consent. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
22. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where federal law or another jurisdiction's nonwaivable law applies. Unless the parties agree otherwise in writing or a separate agreement controls, any action arising from these Terms or the Services must be brought in a state court located in Orange County, Florida, or the United States District Court having jurisdiction over Orange County, Florida. You and CENTURY 21 Edge consent to personal jurisdiction and venue in those courts.
23. General Provisions
If a provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a reorganization, transaction, or transfer of the Services. These Terms, the Privacy Policy, the DMCA Notice, the Accessibility Statement, displayed MLS/IDX terms, and any feature-specific or transaction-specific terms constitute the applicable agreement for the Services. A separate written brokerage, listing, buyer representation, lease, purchase, referral, or transaction agreement controls if it conflicts with these website Terms concerning that transaction.
